•Proprietary Ownership: All content included on this website, including but not limited to jewelry designs, unique product names, imagery, photographs, graphics, logos, text, button icons, digital downloads, data compilations, and software, is the exclusive property of The Quirky Karat and is protected by Indian and international copyright, trademark, and intellectual property laws.

•Strict Restrictions: You are granted a limited license only for purposes of viewing the material contained on this website. You must not copy, reproduce, duplicate, sell, resell, exploit, modify, or redistribute any product images, designs, or textual content from this website for any commercial purpose without express written consent from us.

3. Online Store Terms & Account Security

•Prepaid Structure Only: The Quirky Karat operates strictly on a Prepaid-Only business model. We do not provide Cash on Delivery (COD) under any circumstances. Orders are only verified and processed once clear payment confirmation is verified via our secure payment partners.

•Account Responsibility: If you create an account on our website, you are entirely responsible for maintaining the confidentiality of your account credentials and password. You agree to accept full responsibility for all activities and purchases that occur under your account.

•Breach of Terms: Any fraudulent activity, fake identity creation, or violation of these Terms will result in an immediate termination of your access to our Services and potential legal reporting.

4. Accuracy of Pricing, Billing, & Product Information

•Modifications to Prices: Prices for our jewelry items are subject to change without prior notice. We reserve the right at any time to modify or discontinue any product, design, or service without liability to you or any third party.

•Aesthetic Deviations: We make every effort to display the colors and textures of our products as accurately as possible. However, because our jewelry features unique crafting methods and digital screen displays vary, minor aesthetic shifts, color shade variations, or natural textures are characteristic of the items and will not be classified as defects.

•Right to Refuse Orders: We reserve the clear legal right to refuse, limit, or cancel any order you place with us. This includes, but is not limited to, orders that appear to be placed by dealers, resellers, or distributors, or orders containing obvious system pricing errors or inventory stock inaccuracies.

5. Alignment with Store Policies

•Absolute Policy Integration: Our Shipping Policy, No-Refund / Return Policy, and Warranty Disclaimer are fully incorporated into these Terms of Service. By completing a checkout transaction, you explicitly acknowledge and agree to the following binding criteria:

• Delivery Timeline: Standard orders take 5 to 7 business days to deliver across India. Custom-made or personalized jewelry requires an additional 7 to 10 business days for production prior to dispatch.

 

• No Refunds & No Warranty: All sales are completely final. All items are sold strictly on an "As-Is" basis with no express or implied corporate warranties on tarnishing, plating, or stone durability.

 

• Mandatory 48-Hour Unboxing Window: Claims for transit damages, wrong items, or missing pieces are strictly rejected unless reported via email (thequirkykarat@gmail.com) or WhatsApp (+91 9748864850) within 48 hours of delivery, accompanied by a continuous, unedited unboxing video.6.

6.Limitation of Liability & Indemnification

•Cap on Liability: In no event shall The Quirky Karat, our directors, officers, employees, or affiliates be liable for any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including without limitation lost profits, lost revenue, or replacement costs, arising from your use of any of our products or services.

•Product Wear and Tear: We are entirely exempt from liability regarding natural metal oxidation, accidental breakages, or product degradation resulting from exposure to water, perfume, sweat, or cosmetics.

•Indemnity: You agree to indemnify, defend, and hold harmless The Quirky Karat from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service or your violation of any law or the rights of a third party.

7. Governing Law & Dispute Resolution

•Legal Jurisdiction: These Terms of Service and any separate agreements whereby we provide you Services shall be governed by, interpreted, and construed in accordance with the laws of India.

•Exclusive Courts: Any legal disputes, claims, conflicts, or chargeback challenges arising out of transactions on this platform shall be subject to the exclusive jurisdiction of the competent courts located in Bangalore, Karnataka,India.
